In consideration of the services provided by Miracle Excursions Ltd., doing business as ‘Zanzibar Submarine Tours,’ and its affiliated advertisers, travel agents, tour operators, and sponsors (collectively referred to as the ‘Affiliated Parties’) issuing to me a pass valid for any of their activities, I, the undersigned, hereby release, indemnify, and hold harmless Zanzibar Submarine Tours and the Affiliated Parties, as well as their respective directors, officers, agents, and employees, from any and all claims, demands, damages, actions, and causes of action arising out of or in connection with any loss of life, personal injury, or property damage that may be sustained or incurred while participating in a Semi-Submarine Tour and Speedboat Charter.
I further agree not to initiate or participate in any claims or legal proceedings against Zanzibar Submarine Tours or the Affiliated Parties, or any person who might seek contribution or indemnity from Zanzibar Submarine Tours or the Affiliated Parties, or their respective directors, officers, agents, and employees.
I hereby declare that I am in appropriate physical and medical condition to participate in the Semi-Submarine Tour and Speedboat Charter. I acknowledge that participation in such activities involves inherent risks that could, in certain circumstances, result in injury, damage, or death.
When acquiring any service provided by Zanzibar Submarine Tours, I acknowledge that I have had sufficient opportunity to review and consider the terms of this agreement and that I understand and voluntarily accept its terms.
In consideration of Zanzibar Submarine Tours and its Affiliated Parties issuing to me a pass for a Semi-Submarine Tour and/or Speedboat Charter, I agree to hold harmless Zanzibar Submarine Tours and its Affiliated Parties and their respective directors, officers, agents, and employees from and against all losses, costs, and expenses, including legal expenses, that they or any of them may pay, sustain or incur for or by reason of my death or injury to my person or damage to the property that I may sustain or incur while participating in the Semi-Submarine Tour and/or Speedboat Charter.
All Zanzibar Submarine Tours vehicles are covered by an insurance package that also provides protection against any unlikely events resulting in injuries, caused due to our or our employees’ negligence. A copy of our insurance certificate is available for review.
